UNDERINSURED MOTORIST'S CLAIM

Our client was driving on Tamalpias Drive in the City of Corte Madera, County of Marin, when a driver who was going the opposite direction suddenly made a left hand turn in front of him. Within a couple of weeks he began seeing flashes of light. We were able to establish that he had suffered a traumatic detachment of both retinas in the collision necessitating a total of 4 procedures on his eyes. After obtaining the $100,000 policy limits of the adverse driver, we proceeded against our client’s own insurance carrier based upon his underinsured motorist coverage. In May of 2008, we were able to bring our client’s total recovery to $212,500 after mediation with his insurance carrier.
