IMPLIED COVENANT AND COMMON LAW FRAUD

Our firm recently obtained for our clients, a computer training school in Silicon Valley, the harshest civil verdict possible under California civil law. An Alameda County jury found defendants, a San Jose businessman and American Business College International to have committed fraudulent misconduct by entering into an agreement without the intent to perform. An unanimous jury reached verdicts under both the implied covenant and common law fraud. The jury awarded our clients $3,635,200 in compensatory damages and also $1.5 million in punitive damages against one defendant and $150,000 against another.
